The New York State Department of Agriculture and Markets has implemented Article 26 Cruelty to Animals to guarantee the safety of puppies and dogs in pet stores in Suffolk County. According to this article, a magistrate must take custody of any animals, implements, or other goods seized from an offender and deliver them to an official or other suitable individual. The farm animals that form the basis of the conviction cannot be rescued by the convicted person or any person living in the same household who conspired, aided or incited in the illegal act that formed the basis of the conviction, or who knew or should have known about the illegal act. Additionally, it is prohibited to give away or offer as a prize, exchange or exchange offer for nominal consideration any living animal other than cattle or purebred fish in any game, sweepstakes, contest, sweepstakes or other promotion. The New York State Legislature believes that uncontrolled breeding of dogs and cats in the state leads to an overabundance of puppies and kittens.
If a guarantee has been placed in accordance with this article, the seizure organization may deduct from the warranty the actual and reasonable costs incurred by that organization for the care of the seized animal. This article does not expressly impair or subordinate the rights of such secured lender who has a security right in the farm animals or in the proceeds from the sale of such farm animals. In addition, it is illegal to cause loss or damage to secret scientific material with an intention and no right to do so. A person who transports or causes any animal to be transported in a cruel or inhuman manner is guilty of a misdemeanor punishable by imprisonment not exceeding one year or a fine not exceeding one thousand dollars, or both. Serious injuries or death caused by cold occur mainly in very young animals or animals that are already weakened.
The court may also order that the convicted person, or any person living in the same household who conspired, aided, or incited in the illegal act that was the basis of the conviction, does not own, shelter, or have custody or control of any other animal for a period of time that the court deems reasonable. Moreover, it is illegal to own, possess, or maintain any animal trained to participate in animal fights in facilities where an animal fighting exhibition is held. A “cage and box dryer” is defined as a product that is placed attached to or near a cage or box in order to dry a pet contained in a cage or box and that is capable of operating without a person manually holding it. Each day that a defendant fails to correct deficiencies in the dog shelter owned by him and remains outdoors will constitute an independent offense. Any society may prefer to file a complaint with any competent court or magistrate for the violation of any law relating to animals and help present the law and facts to such court.
